These draft terms describe the proposed terms for using CareTrain, a caregiver training service operated by BrightPath Home Care LLC. They require product-owner and legal review before the commercial production service launches.
The service
CareTrain provides caregiver training delivery, assignments, knowledge assessments, progress tracking, training records, and annual completion certificates. Available content and language options are described in the service. An annual certificate is available after completion of all six required courses in the same annual cycle.
Agency accounts and authorized users
Agencies are responsible for the accuracy of information they provide, designating authorized administrators, assigning appropriate training, and maintaining authorized caregiver access. Users must protect account credentials and use their own accounts. Initial agency onboarding is controlled; a public website visit does not create an agency or grant training access.
Subscriptions and payments
A subscription applies to one agency. The selected price, billing frequency, and applicable charges are presented before checkout. Stripe processes payments and provides hosted billing management. CareTrain does not collect raw payment-card details. The current advertised offer does not guarantee an unchanged price for future subscriptions or renewals; applicable changes and notice must be communicated before they take effect.
Cancellation and payment issues
Authorized agency administrators can manage available billing options through the Stripe Customer Portal. A cancellation scheduled for the end of the paid period retains access while the subscription remains active. Cancellation takes effect as reflected in the subscription status. Payment issues or an ended subscription may pause new training and agency management actions until the subscription is restored.
Existing training history and earned certificates remain preserved and accessible to otherwise authorized users during a billing lapse. Cancellation does not delete historical records. No refund policy is finalized in this draft; the owner must establish and disclose the applicable policy before live sales.
Acceptable use and training content
Use CareTrain only for authorized training and administration. Do not share accounts, bypass access controls, interfere with the service, access another agency’s data, falsify training evidence, or copy, redistribute, or exploit training content without permission. CareTrain branding, software, and training materials remain subject to the rights of their respective owners. Access to the service does not transfer ownership.
Training limitations
The six-course annual package and assessment passing policies are CareTrain product policies. They are not a representation that Colorado universally requires every caregiver to complete these exact courses annually. Agencies remain responsible for determining applicable legal, licensing, role-specific, and agency requirements. CareTrain does not guarantee regulatory compliance.
Video education, knowledge assessments, and completion certificates do not replace separately required hands-on competency evaluation or skills validation. A certificate documents completion of CareTrain’s training program; it does not establish professional licensure or independent competency validation.
Availability and account restrictions
CareTrain may experience maintenance, interruptions, or provider outages. Availability is not guaranteed by these draft terms. Access may be restricted for unauthorized activity, compromised accounts, or violations of the terms. Account restrictions must preserve historical training evidence and be distinguished from ordinary subscription cancellation.
Privacy and agency records
The Privacy Policy describes current data handling and providers. Agencies remain responsible for entering appropriate information and authorizing its use. CareTrain preserves historical assessment and completion evidence rather than silently rewriting it when profiles or course content change.
Final governing terms
BrightPath Home Care LLC must approve the final governing-law, dispute-resolution, liability, refund, and account-closure provisions with appropriate legal review before production launch. This draft does not invent those provisions or promise a particular legal outcome.
